This is a translation for your convenience. The German version is legally binding.

1. Provider

The services are provided by:

Turazon LLC
(hereinafter “provider” or “The Regulated Athlete”)

You find the full contact details in the imprint.

2. Scope

These terms and conditions apply to all services of The Regulated Athlete to consumers (§ 13 German Civil Code, BGB) and businesses (§ 14 BGB).

Deviating terms of the customer are not recognised unless their validity has been expressly agreed in writing.

3. Services

The Regulated Athlete offers in particular the following services:

  • free Blindspot Checks,
  • the digital programme “Umschalten”,
  • paid Clarity Sessions,
  • the time-limited starter group “Kona 27”,
  • masterclass and other webinars,
  • digital content, video recordings and training materials,
  • individually agreed, longer-term coaching programmes and coaching services.

The exact scope, price and duration result from the respective offer or checkout page at the time of the order, or from the individual agreement. These terms set out the legal framework; they do not set prices or programme content.

4. No promise of healing

The services serve to optimise recovery, resilience and performance.

They are no medical treatment and replace neither medical diagnoses nor therapeutic measures.

No particular sporting, health or economic success is owed.

5. Conclusion of contract

A contract is concluded by:

  • booking via the website,
  • accepting an individual offer,
  • a written agreement,
  • or the start of the service.

The presentation of the services on the website is no legally binding offer.

6. Free Blindspot Check

The Blindspot Check is offered free of charge.

There is no entitlement to it being carried out. The Regulated Athlete reserves the right to decline requests without giving reasons.

The analysis is an assessment based on the information provided and does not replace medical diagnostics.

7. Clarity Session

The Clarity Session is a one-off consulting service.

The price is the one stated on the respective booking page at the time of booking and is due before the session. The session takes place online and is not recorded.

The participant is aware that the results depend on how complete and accurate their information is.

This is a service within the meaning of § 356 (4) BGB. If the customer expressly agrees that the booking or the service takes place before the cancellation period ends, the rules on the early expiry of the right of cancellation for services apply as set out in the cancellation policy.

8. Umschalten

Umschalten is a digital 5-day programme you buy once, consisting of daily emails and audio content.

The purchase price is the one stated on the respective checkout page at the time of the order. Payment is processed by an external payment service provider who acts as reseller and appears accordingly on the customer’s statement.

The content is delivered automatically by email, starting after payment has been received. This is digital content within the meaning of § 356 (5) BGB; the rules on the early expiry of the right of cancellation apply as set out in the cancellation policy.

9. Individually agreed coaching programmes

In addition to the services named separately in these terms, The Regulated Athlete offers individually configured, longer-term coaching programmes on request (e.g. ongoing support, coaching programmes over several months or annual programmes).

Scope, price, duration and payment terms result from the individual offer or invoice the customer receives before the service starts, or from a separate written agreement. These terms additionally govern the legal framework.

Unused content, appointments or services expire at the end of the agreed term unless agreed otherwise. There is no guarantee of particular sporting, health or economic results. Early termination is only possible under the individually agreed conditions.

10. Masterclass and webinars

The masterclass and other webinars may be offered free of charge or for a fee.

The provider is entitled to

  • reschedule dates,
  • adapt content,
  • replace speakers,
  • or cancel events for good cause.

In this case, participation fees already paid are refunded in full. There are no further claims.

11. Digital content, videos and materials

All content provided, in particular:

  • videos,
  • presentations,
  • PDFs,
  • work materials,
  • graphics,
  • concepts,
  • documents,

is protected by copyright. Passing it on to third parties, copying, publishing or commercial use is not permitted without prior written consent.

Access data is personal and may not be shared.

12. Appointments and cancellations

Booked appointments can be rescheduled free of charge up to 24 hours before they start.

In the case of short-notice cancellation or no-show, the service counts as provided. In this case there is no entitlement to a replacement appointment.

13. Customer’s duty to cooperate

The customer undertakes to provide all information required for the service completely and truthfully.

The success of the collaboration depends largely on the customer’s active participation.

14. Liability

The Regulated Athlete is liable without limitation in the case of:

  • intent,
  • gross negligence,
  • injury to life, body or health.

In the case of slight negligence, the provider is only liable for breaches of essential contractual obligations and limited to the foreseeable, typical damage.

15. Applicable law

Turazon LLC has its registered office in the United States of America.

For consumers whose habitual residence is in Germany, mandatory consumer protection provisions of German law remain unaffected.

Otherwise, the law of the state in which Turazon LLC has its registered office applies.

16. Dispute resolution

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr

The Regulated Athlete is not obliged and generally not willing to take part in dispute resolution proceedings before a consumer arbitration board.

17. Severability clause
